Artist's Contract...

1. Woman Made Services:

   Woman Made will provide the service of making available a digital representation of my art images and my biographical listing (defined below) to any person who has graphical access to the World Wide Web, in the form of Web pages, within the Woman Made On-line Artist Registry. Woman Made makes no representations as to anyone viewing my listing or art works or frequency of same.

2. Art Works and Listings Defined:

   Art Images is to consist of the following:

   1. - Art Images are to consist of the following: at least five (5) and up to fifteen (15) slides of my artwork for the BASIC webpage or up to 30 images for the ADVANCED webpage

   A listing is to consist of the following:

   2. - biographical information (optional) may only consist of:
      1. up to three (3) 8 ½"x11" - typed pages of biographical, contact and current exhibition information;
      2. one (1) artwork selected from the 15 images or one (1) photo of myself or self-portrait for the mainpage.

   I warrant that all materials (art images and listing) are entirely owned by myself and do not violate any copyright, trademark or other laws. I agree to hold Woman Made harmless and indemnify Woman Made from anyone's assertion of any such type of violation or claim.

3. Terms and Costs:

   I understand that for Woman Made to provide the above described services, I am subject to the following terms and costs:

   1. There is a minimum one (1) year obligation to this agreement after which this agreement is self-renewing, at the cost described below, unless I inform Woman Made in writing to end this service.
   2. The total cost for the first year is two hundred fifty ($250) dollars which consists of:
      1. $150 annual hosting and $100 for the account and page set-up.
      2. Each additional year currently costs one hundred fifty dollars ($150).
   3. Full payment of $250 for one year must be received in advance, (or see d.)
   4. I have the option to use a payment plan of four (4) equal monthly installments of seventy dollars ($70.00) each of which includes a 12% fee. The first installment is payable to Woman Made before my web page is processed.
   5. My listing and art images will be updated subject to the following costs:
      1. updating one art image will cost ten ($10) dollars.
      2. typesetting will cost ten ($10) per total changes per incident.
   6. Any increase in fees will be made with at least sixty (60) days notice prior to the end of a 12 month term.
   7. All rates quoted are in US Dollars.

4. Additional Terms:

   1. I understand that Woman Made reserves the right to refuse to publish any of my submitted materials at Woman Made's sole discretion with or without any reason whatsoever. Woman Made will notify me if any of my submitted materials are rejected, and will let me provide other materials within a reasonable time or return my money.
   2. I have included a self-addressed stamped envelope with this contract so that Woman Made may return any materials to me. Woman Made is not responsible for the safe return of any submitted materials.
   3. I hereby indemnify and agree to defend and hold Woman Made Gallery harmless from and against any and all liabilities, claims, damages, judgments, losses, costs and expenses, including reasonable attorneys' fees and costs of settlement incurred or sustained by Woman Made or any affiliate of Woman Made because of any breach or violation of the terms of this agreement by myself, caused by any act or omission on my part or those acting on my behalf.
   4. I agree to hold Woman Made harmless from any and all damages, losses, legal procedures and other expenses related to any use by any third party of my art images and listing published in the Woman Made Artist Registry.
   5. I agree that Woman Made's maximum and total liability is limited to the return of fees paid by me to Woman Made.
   6. In an attempt to protect my art images & listing from copyright infringement, a copyright notice will be placed on each page. I agree to hold Woman Made harmless for any violation in this regard as being beyond this contract with Woman Made.
   7. I understand that my slides are going to be electronically scanned and reproduced to achieve a high quality on-line reproduction, but being in a different medium, the quality of depth, color or overall visual characteristic of my art images may vary from my originals and will vary from computer system to computer system.
   8. The art images I submit to Woman Made for scanning and reproduction will be in professionally-done slide-format, in order to be scanned and reproduced electronically.
   9. This web space is not designed to be and cannot be self-maintained.
   10. Use of my WomanMade.net E-mail address and web area is subject to Terms of Use as posted at http://womanmade.net/tos.html. By signing this agreement I state that I have read and agreed to these Terms of Use.
   11. I understand that failure to comply with any of the terms of this agreement will constitute a breach of contract and my account may be closed and no refund will be due to me.
   12. This agreement shall be construed and interpreted under the laws of the State of Illinois.

I have read, understand and agree with all conditions presented in this agreement.
